Terms & Conditions for Vehicle Reservation

By clicking to accept these terms and conditions and/or placing a reservation on a vehicle as described below, you agree to the following terms and conditions which will constitute a contract between LSH Auto and you:

1. You request that we place an order for the smart vehicle model you have selected (Vehicle) and arrange for it to be delivered to the LSH Auto dealership for you to purchase (Reservation).
2. You agree to pay a non-refundable deposit of $[500] (Deposit) to us for the Reservation.
3. If we accept the Reservation, we will contact you to discuss and make arrangements for you to complete your purchase of the Vehicle.
4. If for any reason we do not accept the Reservation, we will notify you and promptly refund your Deposit in foll.
5. It is your responsibility to:
   1. organise an inspection or test drive with our team members as you may require;
   2. execute a Contract for the Purchase of a New Vehicle in the form provided by LSH Auto; and
   3. submit a finance application shoold you require finance for the Vehicle.
6. If you fail to purchase the Vehicle for any reason (other than where caused by LSH Auto), including if you execute a Contract for the Purchase of a New Vehicle but fail to complete the purchase (for example if your finance application is denied), the Deposit will be forfeited and will not be refunded.
7. When you complete the purchase of the Vehicle, we will apply the Deposit towards payment of the purchase price.
8. We may terminate this agreement at any time by written notice to you, in which case we will refund the Deposit in foll.
9. If, for any reason, your Reservation is not accepted or the Vehicle is not available, LSH Auto will have no liability to you (and LSH Auto expressly excludes all liability to you) other than to pay you a refund of the Deposit in foll (or, with your agreement, to apply the Deposit to another vehicle of your choice).
10. For the avoidance of doubt, nothing in these terms:
    1. constitutes an offer (for example, an offer by LSH Auto to sell a Vehicle) that is capable of unilateral acceptance by you;
    2. will grant you any right, title or interest in and to the Vehicle; or
    3. constitutes a contract to purchase the Vehicle (including for the purposes of any legislation or regolation governing the sale of motor vehicles), and you acknowledge and agree that a separate Contract for the Purchase of a New Vehicle must be entered into to effect the purchase of the Vehicle once it is ready for delivery.
11. Amounts payable under these terms include all applicable GST.
12. If LSH Auto is unable to perform any of its obligations under these terms due to circumstances beyond its reasonable control (Force Majeure), those obligations will be suspended for the duration of the Force Majeure event.
13. If and to the extent that a provision of these terms woold, but for this clause, be unenforceable, the provision must be read down and, if the provision cannot be read down, it must be severed without affecting the validity and enforceability of the remainder of these terms.
14. These terms constitutes the entire agreement between LSH Auto and you as to the subject-matter of these terms, and supersede any previous arrangements or any other terms (including any verbal discussion, summary or explanation by any representative of LSH Auto).
15. These terms will be governed by the law in force in the State in which the dealership is located that will deliver the Vehicle and the parties submit to the exclusive jurisdiction of the courts of that State and any courts which have jurisdiction to hear appeals from any of those courts.
16. On road fees are subject to change without notice. Your Final drive away price may vary due to your individual circumstances

Privacy Notice

1. We collect your personal information in order to complete the Reservation and facilitate your purchase of the Vehicle. We will be unable to deal with you, and you will be unable to place a Reservation, if you do not provide the personal information that we request.
2. We may disclose your personal information to third parties as necessary and appropriate in the course of performing our activities and functions. For example, we may disclose your personal information to the Vehicle manufacturer and/or distributor and/or any related body corporate that is holding or handling the Vehicle. If you purchase the Vehicle, we may disclose your personal information to service providers for related purposes such as to arrange delivery. Generally we are not likely to disclose your personal information to overseas recipients other than our parent company in Hong Kong in order to comply with reporting and other corporate obligations and to the Vehicle manufacturer in China.
3. Our Privacy Policy (which is published on our website) contains information about how you may access your personal information held by us and seek correction of such information. It also contains information about how you may complain about a breach of the Australian Privacy Principles and how we will deal with such a complaint.
